  • S.W.I.S. Insurance uses a personal approach in case of damage. On the basis of the information collected, S.W.I.S. Insurance determines together with you which steps need to be taken.
  • After reporting the damage to the insurance company, S.W.I.S. Insurance takes care of appointing an expert.
  • If possible, S.W.I.S. Insurance arranges a direct payment to the repairer.

Advices in case of damage

 

Immediately inform your broker.

When someone (a third party) causes you material or physical damage or when your interests are threatened or damaged by a dispute, inform your insurance broker as soon as possible.

Do the same when a counterparty sues you as a result of damage or a dispute. Do not wait until you are summoned to appear in court. According to our insurance legislation, your right to legal aid lapses after 3 years. In other words, if you do not report your damage or dispute within three years, you can no longer fall back on the cover provided by your legal aid policy.

Consider as a claim or dispute every conflict situation for which you are insured in legal aid and of which you can reasonably know that it can sooner or later result in a lawsuit. It does not matter whether or not the third party or adversary is known at the time.

If, for example, you are the victim of a theft, you must report the theft not only to the police, but also to your estate agent. He will immediately inform your insurer and Euromex. So don't wait to report the theft until the perpetrators have been found or have to appear in court.

 

Briefly and clearly describe the problem.

Your estate agent is in an excellent position to inform you of the extent to which you can call on your legal aid policy. He will give you excellent advice and take immediate action to defend your interests fully together.

Give him a brief and clear description of the problem. Provide him with all the documents that may be useful in handling your case and in assessing the damage or the dispute.

 

Which documents are useful?

  • Certificate of deposit of the complaint with the police;
  • Photographs of the damage to your movable or immovable property;
  • Price quote from your repairer: car dealer, contractor, plumber;
  • A copy of the correspondence and e-mails between you and the other party;
  • Name and address of the other party;
  • A copy of the notice of default sent to you by the other party.

 

First opt for an amicable settlement.

If you wish to engage the services of a lawyer, first consult your estate agent.

The right to the intervention of a lawyer is limited to the judicial phase of dispute resolution.

In the first phase, a specialised team is at your disposal to defend your interests in the best possible way. This team often manages to settle a case quickly and efficiently in your interest without the intervention of a court.

It is therefore certainly not always necessary to hire a lawyer or to litigate. On the contrary, the vast majority of disputes are resolved amicably. This avoids your file ending up in the judicial file.

 

Ask your insurance broker for advice on the choice of lawyer.

Of course, there are also cases that can only be settled through the courts.

In this case, you have the right to choose a lawyer yourself. This is difficult for a private individual. Without practical experience, he or she must choose a suitable lawyer from 15,000 Belgian lawyers.
